Welcome to Bad Moon LLC. These Terms of Service (“Terms”) govern your use of our website, services, and communications, including Bad Moon pedicab experiences and Ride Buddy bicycle recovery and rider-support services.
By using our website, booking a service, requesting a Ride Buddy recovery, riding with us, or otherwise using our services, you agree to these Terms.
1. Who We Are
Bad Moon LLC (“Bad Moon,” “we,” “our,” or “us”) is an Arkansas company providing transportation and rider-support services in Northwest Arkansas.
Our services currently include:
Bad Moon, a passenger pedicab and bicycle experience service; and
Ride Buddy, a bicycle recovery and rider-support service that connects cyclists who need assistance with available drivers.

2. Eligibility
You must be at least 18 years old to book or request a service.
Guests under 18 may participate in a Bad Moon pedicab ride when accompanied by a parent or legal guardian.
If you book or request a service on behalf of another person, you represent that you have permission to do so and that the person receiving the service has been informed of any terms that apply to them.
3. Bookings, Service Requests & Availability
Bad Moon pedicab experiences may be booked through our website or directly with us.
Ride Buddy recovery services may be requested through our website, by text message, or through another method we make available.
Submitting a Ride Buddy request does not guarantee that a driver will be available. A recovery is confirmed only after we notify you that the request has been accepted or a driver has been assigned.
Service availability may depend on factors including driver availability, your location, trail or road access, weather, traffic, distance, and safety conditions.
We may decline or discontinue a service when we reasonably believe completing the service would be unsafe, unlawful, impractical, or outside the services we provide.
4. Pricing & Payments
Prices may vary by service, location, duration, distance, demand, or other factors.
We will provide or display applicable pricing before you confirm a paid service whenever reasonably practicable.
Payments may be processed through third-party payment providers such as Stripe. Bad Moon LLC does not store your complete payment-card information.
By authorizing payment, you represent that you are authorized to use the payment method provided.
5. Cancellations & Refunds
Unless a different cancellation or refund policy is provided at the time of booking, cancellations and refunds are handled at our discretion.
If you need to cancel or modify a service, please contact us as soon as possible.
We may cancel or reschedule a service because of severe weather, unsafe conditions, mechanical problems, driver availability, road or trail closures, emergencies, or other circumstances affecting our ability to safely provide the service.
If we cancel a prepaid service and cannot reasonably provide or reschedule it, we will provide an appropriate refund.
6. Bad Moon Pedicab Safety
Guests participating in a Bad Moon pedicab experience must follow reasonable safety instructions provided by the pedicab operator.
By participating, you acknowledge that pedicab transportation involves inherent risks, including risks associated with traffic, road or trail conditions, weather, equipment, and the actions of other people.
You are responsible for determining whether you are physically able to participate. If you have a medical condition or concern about your ability to safely participate, you should consult an appropriate medical professional.
You are responsible for personal property brought on a ride. Bad Moon LLC is not responsible for lost, stolen, or damaged personal belongings except to the extent required by applicable law.
7. Ride Buddy Bicycle Recovery Service
Ride Buddy is designed to provide non-emergency bicycle and rider recovery assistance.
Depending on the circumstances, this may include transporting a cyclist, bicycle, or both from a roadside, trail-access point, or other location accessible to the assigned driver.
Ride Buddy is not an emergency medical service, ambulance service, rescue service, law-enforcement service, or substitute for 911.
If you believe you or another person is experiencing a medical emergency, is seriously injured, is in immediate danger, or requires professional emergency rescue, call 911 or the appropriate emergency service rather than relying on Ride Buddy.
Access and Pickup Locations
Ride Buddy drivers may only travel to locations they can safely and legally access.
You may be asked to move to a safer or more accessible meeting point. Drivers are not required to enter trails, restricted roads, private property, dangerous terrain, or other locations they reasonably determine are unsafe or inaccessible.
Bicycle Transportation
You are responsible for accurately describing your bicycle and any relevant equipment before pickup.
Although we take reasonable care when transporting bicycles and equipment, bicycle transportation involves some risk of cosmetic or other damage. You should notify the driver of particularly fragile, unusual, or high-value equipment before loading.
8. Your Responsibilities
When using our services, you agree to:
provide accurate information about your location, contact information, bicycle, passengers, and service needs;
follow reasonable safety instructions from our operators or drivers;
treat drivers, operators, other guests, and members of the public respectfully;
avoid requesting transportation of illegal or dangerous items;
not use our services for unlawful purposes; and
notify us of relevant conditions that could materially affect our ability to safely provide the requested service.
We may refuse or terminate service if a customer behaves in a threatening, abusive, dangerous, fraudulent, or unlawful manner.
9. Assumption of Risk & Limitation of Liability
Transportation, cycling, roadside assistance, and outdoor activities involve inherent risks. These may include traffic, weather, road or trail conditions, falls, collisions, mechanical failures, loading or unloading bicycles, the actions of third parties, and other conditions outside our control.
By voluntarily using our services, you acknowledge and accept the ordinary and inherent risks associated with the service you request.
To the fullest extent permitted by applicable law, Bad Moon LLC and its owners, employees, contractors, operators, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law, including liability resulting from gross negligence or willful misconduct where applicable.
10. SMS & Text Messaging Terms
Ride Buddy uses text messaging as an important part of the recovery and dispatch process.
These SMS terms apply to customers and Ride Buddy drivers who communicate with our Ride Buddy business number.
What We Send
Ride Buddy sends transactional messages related to a recovery request, booking, or driver activity.
Messages may include:
confirmation that we received a pickup or recovery request;
pricing or terms that require your approval before dispatch;
notice that a driver has been assigned;
driver en-route, arrival, or completion notifications;
questions or information needed to complete your recovery;
responses to messages you send us; and
for Ride Buddy drivers, dispatch notifications, job reminders, and on-call confirmations.
We do not send marketing, promotional, or referral messages through the Ride Buddy transactional SMS number.
If we ever offer a separate marketing messaging program, enrollment and consent for that program will be handled separately.
Who We Text
We send Ride Buddy text messages when one or more of the following applies:
you texted our business number;
you submitted a pickup, recovery, or booking request and provided your phone number; or
you are a Ride Buddy driver and provided your phone number for dispatch or service-related communication.
We do not purchase phone-number lists, scrape phone numbers, or use the Ride Buddy transactional messaging service to contact individuals who have not interacted with us or provided their number for the service.
Message Frequency
Message frequency varies.
During an active recovery or dispatch, you may receive several messages within a short period of time. When you do not have an active request, booking, or driver assignment, you generally will not receive Ride Buddy transactional messages.
Message & Data Rates
Message and data rates may apply according to your wireless carrier and mobile plan. These charges are imposed by your carrier and not by Bad Moon LLC.
Stopping Messages
Reply STOP to a Ride Buddy text message to stop receiving SMS messages from that number.
You may receive one final message confirming that you have been unsubscribed.
You may reply START later to resume messaging.
Please understand that because SMS is an integral part of Ride Buddy’s dispatch process, opting out of text messages may limit our ability to provide an SMS-based Ride Buddy recovery. You may contact us through another available method to determine whether alternative arrangements are possible.

Wireless Carriers
Wireless carriers are not responsible for delayed or undelivered messages.
11. Phone Numbers & Service Communications
We use contact information you provide to operate the service you request, including quoting, booking, dispatching, coordinating pickups, sending service updates, processing payments, and answering questions.
For Ride Buddy recoveries, when a driver is assigned, we may provide the customer and driver with information reasonably necessary to coordinate the recovery, which may include names, phone numbers, pickup locations, and service details.
We do not sell phone numbers or share them with third parties for their own marketing purposes.

12. Drivers & Independent Service Providers
Ride Buddy services may be performed by independent contractors or other authorized service providers.
Nothing in these customer Terms creates an employment, agency, partnership, or joint-venture relationship between a customer and a Ride Buddy driver.
The relationship between Bad Moon LLC and its drivers may also be governed by separate agreements and policies.
13. Website Use
You may use our website for lawful personal and business interactions with Bad Moon LLC.
You may not knowingly interfere with the operation or security of our website, attempt unauthorized access to our systems, submit fraudulent service requests, impersonate another person, or misuse our services.
14. Third-Party Services
We may use third-party providers to help operate our business, including services for payments, communications, website hosting, mapping, automation, and related functions.
Your use of certain third-party services may also be subject to the terms and privacy practices of those providers.
15. Service Changes
We may modify, suspend, discontinue, expand, or limit any service or service area at any time.
Because Ride Buddy is dependent on factors such as driver availability, geography, accessibility, and operating conditions, we do not guarantee continuous availability or specific response or arrival times unless we expressly agree otherwise.
16. Governing Law
These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law principles.
To the extent permitted by law, disputes relating to these Terms or our services will be handled in the appropriate state or federal courts located in Arkansas.
17. Changes to These Terms
We may update these Terms as our services, technology, or legal requirements change.
The current version will be posted on our website with the effective date shown at the top.
Your continued use of our services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
